These Terms and Conditions of Sale and Website Use (“Terms”) govern access to and use of the JCM 1 Tactical website located at https://jcm1tactical.com/ (the “Website”), as well as all purchases, orders, gifts, promotional transfers, and other transactions involving products offered by JCM 1 Tactical (“JCM,” “we,” “us,” or “our”).
These Terms should be read together with JCM’s Privacy Policy and Shipping, Returns, and Refunds Policy, each of which is incorporated into these Terms by reference. Additional written terms may apply to particular products, promotions, distributors, retailers, manufacturers, or other transactions.
By creating an account, submitting an order, accepting delivery of a product, or affirmatively checking the box stating that you have read and agree to these Terms, you acknowledge that you have reviewed and agree to be bound by them. Certain provisions concerning Website access and use apply whenever you access or use the Website.
Do not submit an order or purchase, receive, install, transfer, or use a JCM product unless you understand and agree to these Terms.
1. Nature of Products
JCM sells firearm-related components and accessories. Firearms and firearm-related products can cause death, serious bodily injury, or property damage if incorrectly installed, modified, handled, stored, or used.
2. Minimum Age
You must be at least 18 years old to purchase, receive, or accept delivery of a product from JCM.
By submitting an order or accepting a product, you certify that:
- You are at least 18 years old;
- The date-of-birth and identity information you provide is accurate;
- You will provide valid proof of identity and age when requested; and
- You will not allow a person under 18 years old to complete the transaction or accept delivery on your behalf.
JCM may impose a higher minimum age when required by applicable federal, state, or local law.
3. Purchaser Identity and Actual-Purchaser Certification
By submitting an order, you certify that you are the actual purchaser and intended recipient of the product.
You further certify that:
- You are not purchasing or receiving the product as a straw purchaser;
- You are not purchasing or receiving the product for a firearm trafficker;
- You are not purchasing or receiving the product on behalf of a person who is legally prohibited from possessing the product, a firearm, or an associated firearm-related product;
- You are not using another person’s identity, identification, payment information, billing address, or shipping address to conceal the identity of the actual purchaser;
- You have not provided false, incomplete, or misleading information concerning your identity, residency, intended recipient, shipping destination, or intended use; and
- You will not resell, transfer, deliver, or provide the product as part of an unlawful transaction.
JCM may request additional information to verify the identity of the purchaser, recipient, or person providing payment.
4. Legal Eligibility
You certify that you are legally permitted under all applicable federal, state, and local laws to purchase, receive, possess, install, use, and transfer each product ordered from JCM.
You further certify that you are not prohibited under applicable law from possessing a firearm or any firearm-related product involved in the transaction.
Federal and state laws contain numerous prohibitions, definitions, exceptions, and procedures for restoration of rights. Without representing that the following list is exhaustive or directly applicable to every JCM product, prohibited categories under federal firearm law may include persons who:
- Have been convicted of a crime punishable by imprisonment for more than one year, subject to applicable definitions and exceptions;
- Are fugitives from justice;
- Are unlawful users of or addicted to controlled substances;
- Have been adjudicated as mentally defective or committed to a mental institution, as those terms are defined by applicable law;
- Are unlawfully present in the United States;
- Fall within a prohibited nonimmigrant-alien category, subject to applicable exceptions;

5. Compliance With Applicable Laws
Before purchasing, receiving, possessing, installing, modifying, using, transporting, or transferring a JCM product, you are responsible for determining whether the activity is lawful in every applicable jurisdiction.
By submitting an order or accepting a product, you certify that:
- The product is lawful to purchase, receive, possess, install, and use in your jurisdiction;
- You have reviewed the laws of the state and locality in which the product will be received, possessed, installed, and used;
- You will comply with all applicable federal, state, and local laws;
- You will not install or use the product in a manner that creates an unlawful firearm or prohibited firearm configuration;
- You will not use the product to unlawfully manufacture, assemble, modify, convert, possess, transfer, or distribute a firearm;
- You will not use the product to create or possess an unlawful unserialized firearm;
- You will not use the product to evade any licensing, serialization, background-check, transfer, registration, roster, assault-weapon, magazine, or other legal requirement;
- You will not export or transfer the product in violation of applicable law; and
- You will obtain independent legal advice when you are uncertain whether a proposed purchase, possession, installation, transfer, or use is lawful.
JCM does not represent that a product is lawful in every jurisdiction merely because it appears on the Website or because JCM accepts or ships an order.
6. Changes in Law or Product Classification
Firearm laws, regulations, interpretations, and product classifications may change.
JCM may modify product availability, sales procedures, shipping restrictions, identity-verification requirements, certifications, or these Terms in response to:
- New legislation;
- Regulations;
- Court decisions;
- Agency guidance;
- Enforcement developments;
- Product redesigns; or
- Advice of counsel.
JCM may place an order on hold or cancel an order if a legal change occurs before shipment or delivery.
7. California Transactions
California law imposes additional requirements on certain sales or deliveries of firearm accessories made in California or to California residents.
When a transaction is subject to California Civil Code section 3273.51(e), the purchaser must separately:
- Receive the California notice required by law;
- Affirmatively acknowledge receipt and understanding of that notice;
- Provide proof of identity and age;
- Satisfy applicable address-verification requirements; and
- Comply with applicable identification, package-labeling, signature, and delivery procedures.
The California statutory notice and acknowledgment are separate from acceptance of these Terms. Acceptance of these Terms does not replace the California notice or acknowledgment.
JCM will apply the California procedures when the sale or delivery occurs in California or the purchaser or intended recipient is a California resident.
JCM may place a transaction on hold, request additional documentation, apply the California procedures, or decline the transaction when information associated with the transaction reasonably suggests that the purchaser, recipient, or delivery may have a California connection. Relevant information may include a California:
- Billing address;
- Residence;
- Shipping or delivery address;
- Identification document;
- Payment record;
- Telephone number;
- Prior order history; or
- Intended recipient or destination.
The presence of one of these factors does not necessarily establish that California law applies, but JCM may require additional verification before completing the transaction.
JCM may apply the California procedures or decline the transaction when residency, billing, shipping, identity, intended-recipient, or delivery information is inconsistent or cannot reasonably be verified.
8. Non-California Residency and Destination Certification
When an order is processed as a transaction outside California, you certify that:
- You are not a California resident;
- You are not purchasing or receiving the product for a California resident or another person located in California;
- The product will not be shipped, delivered, redirected, forwarded, or transferred into California as part of the transaction;
- You do not presently intend or reasonably foresee bringing, delivering, forwarding, transferring, or causing the product to be brought into California in connection with the transaction;
- You are not using an out-of-state address, third-party recipient, freight forwarder, mail-forwarding service, or other arrangement to avoid requirements applicable to a California transaction;
- All information you provided concerning residency, identity, billing, shipping, delivery, and the intended recipient is accurate and complete; and
- You will notify JCM before shipment if any information changes in a manner that creates a California connection.
These representations concern the information, circumstances, and intentions existing at the time of the transaction. You remain responsible for complying with all applicable laws concerning any later transportation, delivery, transfer, possession, installation, or use of the product.
JCM may cancel or place an order on hold if it receives information inconsistent with this certification.
9. State-Specific Restrictions
Other states and local jurisdictions may classify or regulate grip modules, magazine-release components, firearm accessories, firearm components, transfers, age verification, shipping, or product configurations differently.
JCM may:
- Refuse to ship to any jurisdiction;
- Require additional certifications or documentation;
- Cancel an order based on legal uncertainty;
- Maintain a list of restricted jurisdictions; and
- Modify shipping restrictions when reasonably necessary to comply with applicable law or JCM policy.
Acceptance of an order does not constitute a legal opinion regarding the laws of the purchaser’s jurisdiction.
10. Prices and Payment
Prices are subject to change at any time without notice. Any price change will not affect an order that JCM 1 Tactical has already accepted, unless otherwise required by law.
Payment in full is due at the time an order is submitted. By submitting an order, the purchaser represents that the payment information provided is accurate and that the purchaser is authorized to use the selected payment method.
All orders are subject to acceptance by JCM 1 Tactical. JCM 1 Tactical may refuse, place on hold, or cancel any order for any lawful reason, including when it reasonably believes that any purchaser representation, certification, or warranty contained in these Terms is false, incomplete, or misleading; the purchaser’s identity, age, residency, payment information, or shipping information cannot be verified; or the transaction may violate applicable law or JCM 1 Tactical policy.
Any applicable sales, use, excise, or other taxes, fees, or governmental charges that JCM 1 Tactical is required to collect will be added to the purchase price and paid by the purchaser, unless JCM 1 Tactical timely receives and accepts a valid exemption certificate.
Submission or authorization of payment does not constitute acceptance of an order. If JCM 1 Tactical declines or cancels an order after payment has been authorized or collected, any applicable payment authorization will be voided or refund issued in accordance with JCM 1 Tactical’s Shipping, Returns, and Refunds Policy.
Except as otherwise required by law or expressly provided in JCM 1 Tactical’s Shipping, Returns, and Refunds Policy or written warranty, all sales are final.
11. Order Review, Refusal, and Cancellation
JCM reserves the right to investigate, place on hold, refuse, or cancel any order when JCM reasonably believes that:
- The purchaser provided inaccurate, incomplete, or inconsistent information;
- Identity, age, residency, billing, shipping, or delivery information cannot be verified;
- The purchase may be for another person;
- The purchaser or recipient may be legally prohibited;
- The quantity, frequency, payment method, shipping arrangement, or customer communications present suspicious circumstances;
- The product may be redirected or forwarded to a restricted jurisdiction;
- The transaction may violate applicable law;
- The product may be used unlawfully;
- Completion of the order may create a substantial risk of harm; or
- JCM cannot confirm the requirements applicable to the transaction.
JCM may request additional identification, residency documentation, purchaser certifications, intended-use information, business credentials, or other information before completing an order.
JCM’s decision not to investigate or cancel one transaction does not waive its right to review or cancel another transaction.
Orders that are refused, placed on hold, or cancelled remain subject to JCM’s separate Shipping, Returns, and Refunds Policy.
12. Limited Warranty
JCM warrants to the original purchaser that, for a period of 30 days from the date of purchase, a JCM-branded product will be free from material defects in materials and workmanship under normal, lawful, and intended use.
The warranty does not cover damage or malfunction caused by:
- Improper installation;
- Unauthorized alteration or modification;
- Use with incompatible components;
- Abuse, misuse, neglect, accident, corrosion, or improper storage;
- Failure to follow instructions or warnings;
- Ordinary wear;
- Use in an unlawful or prohibited configuration;
- Work performed by an unauthorized person; or
- Damage to another product or firearm.
JCM’s obligations under this warranty are limited, at JCM’s election and to the extent permitted by law, to inspection, repair, replacement, or refund of the defective JCM product.
To request warranty service, contact james@jcm1tactical.com before returning any product.
13. Limitation of Liability
To the fullest extent permitted by law, JCM will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the Website, a transaction, or a product.
This limitation does not apply to liability that cannot lawfully be limited or excluded, including liability imposed by applicable product-liability, consumer-protection, or other nonwaivable law.
You acknowledge that contractual limitations do not authorize unsafe, negligent, reckless, or unlawful conduct and do not relieve any party of duties that cannot lawfully be waived.
14. Indemnification
To the fullest extent permitted by law, you agree to indemnify and defend JCM and its owners, officers, employees, agents, contractors, and affiliates from third-party claims arising from:
- Your material breach of these Terms;
- False identity, residency, eligibility, or intended-use information;
- Your unlawful purchase, receipt, possession, installation, modification, transfer, or use of a product;
- Your installation or use of a product contrary to JCM’s instructions or warnings;
- Your unauthorized alteration of a product; or
- Your sale or transfer of a product to a prohibited or unlawful recipient.
This provision does not require indemnification for conduct for which indemnification is prohibited by law.
15. Shipping, Returns, and Refunds
All orders, shipments, deliveries, cancellations, returns, exchanges, and refunds are subject to JCM’s separate Shipping, Returns, and Refunds Policy, which is incorporated into these Terms by reference.
If these Terms conflict with the Shipping, Returns, and Refunds Policy concerning an operational shipping, return, exchange, or refund issue, the more specific provision will control to the extent of the conflict.
16. Privacy
JCM’s collection, use, disclosure, security, and retention of personal information are governed by its separate Privacy Policy, which is incorporated into these Terms by reference. Acceptance of these Terms does not replace any separate notice or consent required by applicable privacy law.
17. Modification of These Terms
JCM may revise these Terms by posting an updated version with a new “Last Updated” date.
The version accepted at the time of a transaction will ordinarily govern that transaction, subject to changes required by law.
Material changes will not retroactively eliminate rights that have already accrued or alter provisions in a manner prohibited by law.
18. Governing Law and Venue
These Terms and disputes arising from them are governed by the laws of the State of California, without regard to conflict-of-laws principles, except where federal law or another jurisdiction’s nonwaivable law applies.
Subject to any valid arbitration agreement or other mandatory legal requirement, legal proceedings shall be brought in the state or federal courts located in San Diego County, California.
19. Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed if necessary. The remaining provisions will continue in effect.
20. No Waiver
JCM’s failure to enforce a provision of these Terms does not waive its right to enforce that provision or any other provision later.
A waiver is effective only if made in writing by an authorized representative of JCM.
21. Entire Agreement
These Terms, together with the applicable product description, Privacy Policy, Shipping, Returns, and Refunds Policy, written warranty, California notice and acknowledgment, and any separate written agreement applicable to the transaction, constitute the agreement between you and JCM concerning the transaction.
If a separate written distributor, manufacturing, promotional, sponsorship, evaluation, or other agreement conflicts with these Terms, the separate agreement controls to the extent of the conflict.
22. No Legal Advice
Information provided on the Website, in product descriptions, in frequently asked questions, in customer communications, or in these Terms is general information and is not legal advice. You should consult a qualified attorney regarding questions specific to your circumstances.
